limitation, the following: <br /> 1. acquisition and construction of public facilities, together with <br /> associated capital improvements, of a useful life of three years or <br /> more; <br /> 2. acquisition of sites for public facilities; <br /> 3. public facility engineering, design and permitting; <br /> 4. construction of all necessary features of public facilities and public <br /> facility sites. <br /> B. Community investment fees shall not be used for periodic or routine <br />maintenance of public facilities. <br /> <br />Sec. 3.18.060 Refund of fees. <br /> The city shall expend or appropriate each community investment fee it <br />collects, with accrued interest, not later than ten years from the date of payment or <br />the city shall refund the fee, with accrued interest, to the fee payor provided the fee <br />payor submits a written request for refund to the office of city administrator within <br />180 days of the expiration of the ten-year period. <br /> <br />Sec. 3.18.070 Implementation. <br /> A. The city administrator may from time to time establish written <br />administrative regulations to facilitate the implementation of this chapter. Such <br />regulations shall be consistent with the purposes and provisions of this chapter. <br />B. The city council shall annually review the community investment fee and, as <br />necessary, shall amend such fee or other provisions of this chapter, in light of the <br />costs of construction of public facilities, inflation indices, and other factors affecting <br />the community investment fee. <br /> <br />Sec. 3.18.080 Effective date. <br /> This chapter shall become effective December 20, 1999. <br /> <br /> Section 2.
