Keany wanted Planning Commission to look at the reference location for State Farm on the adjacent
property line and what the view corridor is from McCaslin looking northwest into the parcel.

Sisk asked about how the open space dedication would be handled.

Martin stated that it had not been fully negotiated.

Levihn liked the project. He had received comments form many parents in favor of a drive-thru.

Howard asked the applicant to have a lighting study done on the lighting coming off the building.
He was concerned about the lighting along McCaslin.

Lathrop was concerned about the visibility issue from McCaslin if you are coming from the south.
He agreed with staff not supporting the glossy, metal awnings on Boston Market. The utilization
of awnings should be uniform in color and application throughout the project.

Mayer was concerned about the screening of the drive-thru not being sufficient. He wanted the trash
enclosure location looked into.

Davidson wanted median cuts on McCaslin discussed at the Planning Commission. He felt they could
still have an awning without the entire building being a sign. He suggested the applicants put a stick
in the ground showing the height of the berming and shrubs that would hide the drive-thru.

Levihn moved that Council move Vintage Real Estate Services on to the Planning Commission with
Council comments, seconded by Howard. All in favor.

RESOLUTION NO. 23, SERIES 1997 - ACCEPTING OF COLORADO DEPARTMENT OF
TRANSPORTATION MINI-GRANT FOR THE EDUCATION AND ENFORCEMENT OF
VEHICLE SAFETY BELTS AND CHILD RESTRAINT SAFETY SYSTEMS

Bruce Goodman, Chief of Police, explained that the State, from Federal funds, will give Louisville
about $5,000 over the next two years to work off-duty officers at an overtime rate in enforcing child
restraint safety systems. This would be based on a California program where they decreased the
number of serious bodily injuries and fatalities by 1,000 in the first six months of the program. It will
achieved with education and citations.

Sisk wanted it enforced as infants and children under 10, only.

Goodman agreed.

Sisk moved that Council adopt Resolution No. 23, Series 1997, accepting CDOTs mini-grant for
education enforcement of vehicle safety belts and child restraint safety systems, seconded by Howard.
All in favor.

8
