City Council <br />Meeting Minutes <br />January 18, 2022 <br />Page 4 of 8 <br />Councilmember Leh stated he is concerned about consumer protection aspects as well. <br />He asked if people should go to the Division of Insurance or the Consumer Protection <br />Agency. Conway suggested starting with the Division of Insurance and then staff there <br />can connect people with the Attorney General's consumer protection division if needed. <br />Public Comments <br />Rob Scott, 946 Arapaho Circle, stated his guaranteed replacement cost is coming in <br />much lower than what it will cost due to a cap on the policy. Conway suggested he file a <br />complaint with the Division so they can understand how the product was marketed to him. <br />Ann Brennen, 888 Larkspur Court, asked if Colorado will do anything requiring insurance <br />companies to give full replacement cost on items without having to do a full inventory. <br />Conway stated this is an ongoing conversation but they are urging companies to be <br />reasonable and agree to a higher percentage than what is required in current law which is <br />at least 30%. <br />Susan Loo, asked how individual insurance payments are affected if you opt into the <br />FEMA debris removal process. Conway stated if you join the group debris removal <br />process the insurance line for debris removal generally goes to the group contract. It is <br />complicated and many issues are still yet to be determined. <br />Gary Chapman, 457 Muirfield, stated his policy has a cap on additional living expenses <br />for both the length of time and the amount. He asked if this is in compliance with Colorado <br />law. Conway stated Colorado law requires 12 months and companies also require an <br />additional 12 months so the 24 month time frame is standard. A percentage or dollar cap <br />on that amount is specifically prohibited under Colorado law. <br />Laurie, 804 Spyglass Circle, asked if insurance companies are supposed to pay out the <br />entire rebuild cost as soon as possible. Conway stated that is not required and it has to <br />do with rebuild cost and how cash value and replacement cost are covered in an <br />individual property. <br />Doug, 804 Spyglass Circle, stated his policy isn't clear how it is impacted by the federal <br />disaster declaration and federal assistance. Conway stated that dependent on the specific <br />policy and gave some recommendations on where to find additional information. <br />FIRE RECOVERY UPDATE <br />City Manager Durbin gave updates on what staff is doing now and what can be expected <br />in the near future. <br />Director Kowar gave an update saying the department is still focused on getting the water <br />supply back on to all residents. Currently there are about 85 homes still without water in <br />or near the burn areas. They are working with the health department testing for Volatile <br />
