<br />Planning Commission <br />Meeting Minutes <br />May 14, 2009 <br />Page 4 of 7 <br />Raddington stated he lives five (5) blocks from the property but he is the property <br />owner of the lot in question. <br /> <br />Sheets ask Raddington if he was willing to try to work this out with the neighbor. <br /> <br />Raddington stated he would be interested but he has had no contact from the <br />man that issued the complaint. <br /> <br />Lipton asked if his RV was in compliance with the other requirements of the <br />ordinance. <br /> <br />Raddington stated he has been compliance with the code. He stated he even <br />purchased a different RV so he would be in compliance on the length of the unit. <br /> <br />Ian Karpel, 926 Lafarge, Louisville, CO stated he was the man that wrote the <br />complaint to the City Manager. He requested to distribute pictures of the RV <br />taken from his back yard. <br /> <br />Pritchard moved and Loa seconded a motion to enter the pictures into the public <br />record. Motion passed by voice vote. <br /> <br />Karpel continued with a discussion of how the location of the RV creates a <br />dominate presence in his backyard, and how it blocks any views they would have <br />from their backyard. He stated that he has had positive responses from Council <br />since he contacted them by email. He is asking for a process to prevent this type <br />of violation of his personal property rights to enjoy his backyard. <br /> <br />Sheets asked if the RV was parked in the yard when he purchased his home. <br /> <br />Karpel stated it was not. It showed up after they had moved in nine years. <br /> <br />Randy Luallin, 301 East Street, Louisville, CO stated he had spoken against the <br />original ordinance because it violates the private property rights of the owner. He <br />feels there is a breakdown in communication and the Commission should look for <br />an alternative way to address this concern. <br /> <br />Rob Tetzel, 1953 Stratmore, Louisville, CO stated that Gary Raddington is his <br />step-father. He stated that Gary has not been doing new with the RV that he <br />hasn't been doing for the past 35 years of owning some type of RV. He stated <br />that Gary travel all winter from November through April with his RV. He also <br />stated that Gary would be leaving next week for a four (4) trip to Alaska. <br /> <br />Commission Questions of Staff <br />Sheets asked if the neighbor could request a variance for fence height. <br /> <br />Wood stated a variance for a fence would be difficult for staff to support. The <br />Board of Adjustment has a set of six (6) criteria and all six must be met. He <br />stated that one of criteria is to demonstrate a hardship. Wood stated he is not <br />sure how a hardship could be demonstrated or explained. <br /> <br />Russell asked if the proposed ordinance change is rejected by the Commission <br />what would be the next step. <br />
