<br />Planning Commission <br />Meeting Minutes <br />NOVEMBER 13, 2008 <br />Page 2 of6 <br /> <br />Conflict of Interest and Disclosure: <br />Tengler stated he is employed by Level 3 a telecommunication company but they <br />are not in competition with AT&T for the mobility service. <br /> <br />Staff Report of Facts and Issues: <br />Wood reviewed the project with the following summary points: <br />. A Special Review Use to erect, and operate a building mounted, <br />CMRS telecommunications facility at 315 South Boulder Road. <br />. The Telecommunications/CMRS facility regulations were adopted in <br />1997 within LMC Section 17.42. <br />. Section 17.42 states "Commercial mobile radio services and is a <br />facility consisting of equipment for the reception, switching or receiving <br />of wireless telecommunications operating at 1,000 watts or less <br />effective radiated power, and utilizing frequencies authorized by the <br />Federal Communications Commission for cellular, paging, enhanced <br />specialized mobile radio, personal communications systems <br />telecommunication services, point to point microwave signals, signals <br />through FM radio transmitters, and singles through FM boosters under <br />ten watts effective radiated power". <br />. Section 17.42.020 of the LMC outlines the types of CMRS facilities and <br />locations where such facilities are allowed and the associated review <br />process which is applicable to the specific type of facility. <br /> <br />Wood stated that during the review of the project Staffs determination is that the <br />CMRS facility request meets the definition of a building mounted facility as the <br />antennae are not mounted within, or camouflaged or concealed by a structure <br />within the definition of A TS. <br /> <br />Other review summary points included: <br />. AT&T Mobility submitted an application to place nine (9) roof mounted, <br />unscreened antennas on the roof of the existing office building located <br />at 315 South Boulder Road. <br />. The support mechanical equipment is to be located in the basement of <br />the office building. <br />. Staff requested the addition of screening because of the proximity of <br />the antennae to the roof parapet. <br />. The overall height of the mounted antennae is approximately 32', <br />which is less than maximum building height of 35'. <br />. Based on compliance with the CMRS design standards an <br />administrative approval for the building mounted CRMS was given in <br />June 2008. In July 2008 the applicant applied for a building permit and <br />received the approved building permit in August 2008. The facility was <br />constructed in accordance with approved plans and finaled by the <br />Building Safety Division on October 30,2008. <br />. A call from one of the tenants at 315 South Boulder Road prompted a <br />review by staff of the adm inistrative approval.
