<br />BY-LAWS <br />RULES OF PROCEDURE <br />of the <br />BUILDING CODE BOARD OF APPEALS <br />City of Louisville, Colorado <br /> <br />ARTICLE 1 <br />INTRODUCTION <br /> <br />Section 1. Authority. These Rules of Procedure are adopted pursuant to the authority stated in <br />Chapter 15.56 of the Louisville Municipal Code. These Rules of Procedure shall apply to the City <br />of Louisville Building Code Board of Appeals. <br /> <br />Section 2. Powers and Functions. The Building code Board of Appeals ("Board") shall have the <br />powers and functions specified in the ordinances of the City and, except as otherwise provided by <br />ordinance, the applicable state statures. <br /> <br />ARTICLE 2 <br />MEMBERS AND OFFICERS <br /> <br />Section 1. Members and Terms. <br /> <br />(a) The Board shall consist of five (5) regular members who are qualified by experience <br />and training to pass on matters pertaining to building construction. Members shall not <br />be employees of the City. Members of the Board shall be appointed by the City <br />Council. The members shall be appointed for three (3) year overlapping terms. <br /> <br />(b) The City Council may appoint one associate member for a term of three (3) years. The <br />associate member may serve in the place of the regular member on the Board during the <br />total or partial absence of a regular member with all the powers, duties, functions, and <br />responsibilities of the absent regular member. The associate member may attend the <br />Board meetings and shall have all of the rights and powers of the regular members, <br />except that the associate member shall not vote on matters before the Board unless <br />serving in the place of a regular member. <br /> <br />( c) The City's Chief Building Official shall be an ex officio member of and shall act as <br />Secretary to the Board, but shall have no vote on any matter before the Board. <br /> <br />Section 2. Vacancy and Resignation. <br /> <br />(a) Vacancies occurring on the Board shall be filled for the remainder of the unexpired <br />term by appointment by the City Council. In the event a vacancy occurs, the Board and <br />the Secretary may submit recommendations to the City Council for the appointment. <br />(b) Any member of the Board wishing to resign should submit a letter of resignation to the <br />Secretary and City Council at least one (1) month prior to the desired resignation date. <br />
