RESOLUTION NO. 14 <br />SERIES 2022 <br />A RESOLUTION APPROVING AND AUTHORIZING THE LOUISVILLE <br />REVITALIZATION COMMISSION'S ENTRANCE INTO AN AGREEMENT AND <br />EXPENDITURE OF FUNDS FOR CONSULTING SERVICES IN CONNECTION WITH <br />THE HIGHWAY 42 REVITALIZATION AREA <br />WHEREAS, The City is a home -rule city and municipal corporation duly organized and <br />existing under and pursuant to Article XX of the Colorado Constitution and Charter of the City; <br />and <br />WHEREAS, the Louisville Revitalization Commission ("LRC") is a public body <br />corporate and politic authorized to transact business and exercise its powers as an urban renewal <br />authority under and pursuant to the Colorado Urban Renewal Law, Part 1 of Article 25 of Title 31, <br />C.R.S. (the "Act"); and <br />WHEREAS, the LRC has identified a consultant, Colorado Community Revitalization <br />Association Inc., dba Downtown Colorado Inc. (the "Consultant"), with vast experience in <br />working with urban renewal authorities to develop revitalization strategies; and <br />WHEREAS, the Consultant has proposed a comprehensive revitalization strategy and <br />action plan (the "Project") for purposes of maximizing the revitalization potential of the Highway <br />42 Revitalization Plan Area ("Plan Area"); and <br />WHEREAS, while the Project and associated expenditure was not previously approved <br />as part of the LRC's budget, the LRC finds that Project will help prevent the spread of blight within <br />the Plan Area by providing a comprehensive revitalization strategy and action plan in furtherance <br />of the purposes of the Act and the Highway 42 Revitalization Area Urban Renewal Plan (the <br />"Plan"); and <br />WHEREAS, the City and the LRC are parties to that certain Amended and Restated <br />Cooperation Agreement, dated April 5, 2011 (the "Cooperation Agreement"); and <br />WHEREAS, pursuant to the Cooperation Agreement, any proposed expenditure by the <br />LRC which has not been previously approved as part of the LRC's budget shall be subject to the <br />prior review and approval of the City Council; and <br />WHEREAS, pursuant to the Cooperation Agreement and Section 5.6 of the Plan, the LRC <br />must provide to the City Council for review and approval any contract contemplated under Section <br />5.6 of the Plan, prior to the LRC's final approval of the contract; and <br />WHEREAS, subject to the City Council's approval authority, the LRC is authorized, <br />pursuant to Section 5.6 of the Plan, to enter into contracts with entities as are determined by the <br />LRC to be necessary or desirable to carry out the purposes of the Plan; and <br />Resolution No. 14, Series 2022 <br />Page 1 of 2 <br />
