12/20/83

Page -7-

and it is possible that some of the money
collected for this program pays his salary.

Councilman Ferrera

Inquired why this ordinance was drawn up _
doesn't the State already have this require-
ment that is enforceable.
Attorney Rautenstraus advised that it did.
It was his understanding that if a person
violated the requirement they would be
cited in County Court - with this ordinance
they could be cited in Municipal Court which
give more flexibility to the officers for
this type of violation. Normally we do
cite people in municipal court for these
type violations - was the same type of situation
as the Inspection Sticker program for vehicles.
Administrator Wurl remarked it would preclude
the people and the officers from having to
travel to Boulder and they could try them here.

Councilman Leary

Commented that up until the State Statute
was passed allowing this, if Louisville Police
ticketed someone for not having this inspection
not only did it not come to municipal court
the City of Louisville got no revenue from
the fine. With this change now municipalities
issue the ticket and collect the fine - in
the past the money went to the State.

Councilman Cummings

Inquired if anyone in Louisville had ever
received this type violation. (No one was
certain). Remarked he felt this was manip-
ulationp felt it should be enforced on that
level - did not agree with it.

Mayor Meier

Commented one of our sister cities to the
west stated that they had never issued an
emmissions citation. Felt that the ordinance
should be published to meet the attainment
area requirement.

Director Leesman

Advised that his department had not chosen
to issue a great number of these citations
basically because of having to travel to
County Court and since this is now available
to the muncipalities favored the ordinance.
It also provides for ticketing a parked car
without an emmission sticker.

-'ouncilwoman Morris

Inquired - on our 72 hours disabled vehicle
ordinance - did that include alleys, streets
and highways? The reply was yes, public
right-of-ways.
