12/6/83

Page -6-

would not vote to give a conditional c.o.
on that until the Building Inspector had an
opportunity to look at these, and he would
want all of these corrected with the ex-
ception of the landscaping. Asked if ad-
ditional trees would be planted in the Spring.
Mr. Wilcox replied that he was not certain _
estimated that approximately a total of 50
trees would be planted.

CONDITIONAL C.O.

Councilman Cussen moved, Councilman Cummings
seconded that the Mormon Church be given
a conditional certificate of occupancy for
December 10, 16, and 17th and after the
Building Inspector has had an opportunity
to inspect to see if all other concerns are
met it can be extended.

Mr. Wilcox stated that was essentially what
they were requesting, with the exception of
the landscaping and the drainage. Their
list to the builder far exceeded the City's~
and they will demand that it be done. They
have a $250,000 bond to insure this. They
had also given them 2 hurry-up work orders
to see that that is completed. Their arrange-
ment with them has been strained also. Felt
that they had given them a black-eye with the
City. There was certain cement work that
they could do - did not feel that it was
feasible to tear our the curb, wheel-chair
and some other areas at this time and re-
placing it would be risky.

MOTION WITHDRAWN

Councilman Cussen then withdrew and his motion
and Councilman Cummings withdrew his second.

Administrator Wurl remarked that at one
of the study sessions, he asked council if
they wished to address this matter. Be-
cause the request was different than the
requirement in terms of the P.D.D. The
Building Inspector did have the authority
to deal with the requirements of the P.D.D.
In the study session, the majority of the
council felt that this matter should be dis-
cussed by them because they were requesting
a temporary or conditional c.o. without
completing the requirements of the P.D.D.
in terms of the landscaping. That was the
only question. Felt that the council should
deal with that portion of it.
