All in favor. Motion <br />carried unanimously. <br /> <br />Kim Burch, 177 Griffith St. stated that he <br />wished to have a block party August 6, 1983 <br />in the daylight hours on Griffith Street and <br />he was requesting the closure of Griffith <br />St. between Monroe and Wilson Streets. He <br />had solicited several of the residents in <br />the area and everyone was in approval of the <br />party. In his letter he requested the City pro- <br />vide ordinances pertaining to live music and <br />alcoholic beverages. Noted from the City <br />Municipal Code that he had to have a special <br />permit for a live band at the residence. He <br />had asked for the ordinances two weeks ago <br />and was just handed the information this <br />evening; therefore wished more clarification. <br /> <br />Attorney Rautenstraus advised that the ordin- <br />ance was adopted approximately 2 years ago <br />which provides that a permit is required for <br />what is called a live musical performance. This <br />would include a live band with a loud amplified <br />system. To obtain a permit you must appear <br />before Council at a public hearing - notice <br />given to the surrounding area of the proposed <br />performance; must pay an application fee. <br />After the public hearing Councilmembers deter- <br />mine~ if it is appropriate to approve the <br />application. <br />Mr. Burch noted that the process takes 30 days. <br />Rautenstraus advised within 30 days of the <br />application Council sets the hearing. It <br />would not have been possible to have the public <br />hearing this evening because notice could not have <br />been given to the neighbors. <br /> <br />Inquired if he could h~~e_apprQ~al then on the <br />street closure. <br />Mayor Meier advised that Council would vote <br />on this after his remarks had been presented. <br />He then informed Mr. Burch the City had had <br />problems previously with loud live bands and <br />that was why this ordinance was adopted. It <br />wasn't that councilmembers doubted that he <br />had contacted all his neighbors, but perhaps <br />one a blcok away may not have been informed. <br />Therefore if a public hearing was held everyone <br />would have an opportunity to attend. Apologized <br />for the tardiness of the information being <br />given him. <br />
