<br />~ouncilman Cummings <br /> <br />Councilman Leary <br /> <br />Vote on Fee of $75.00 <br />per machine <br /> <br />ORDINANCE 1F767 <br />Adopted as Amended <br /> <br />Councilman Leary <br /> <br />11/3/82 <br /> <br />Page -7- <br /> <br />Again reiterated that he did not feel the <br />fee of $100 per machine - 7 machines, $700 <br />a year, $14 a month was not too high, and <br />it did not address the question in the <br />ordinance. <br /> <br />Commented that he did feel the ordinance as <br />_partially a revenue source. amd felt that <br />people paying money in the City do pay 2% <br />sales tax on what they are purchasing. This <br />is a type of service that is exempt from <br />that sales tax, but at the same time it is <br />for an activity that is possibly much less <br />needed than food for example that elderly <br />people, etc. do pay a tax. He reviewed the <br />information provided by the owner; did some <br />calculations that .if 2% sales tax were being <br />collected would average $80 per year per machine. <br />Therefore, he felt that the $75.00 fee was <br />reasonable. <br /> <br />Roll call vote: <br />Morris <br />Cussen <br />Cummings <br />Ferrera <br />Fauson <br />Leary <br />Meier <br />Motion carried 4-3. <br /> <br />Yes <br />Yes <br />No <br />No <br />No <br />Yes <br />Yes <br /> <br />Councilman Fauson moved, Councilman Ferrera <br />seconded that Ordinance #767 - Video Games <br />be adopted as amended. <br /> <br />Referred to section 8.48.080 Location in the <br />ordinance and inquired of Attorney Rautenstraus <br />if it. would suffice to state 500 .ft.. in lieu <br />of 600 ft. from the nearest corner of the <br />building to the nearest Church. <br />Attorney Rautenstraus advised many times it <br />is difficult to make this clear. The reason <br />it was stated as such in the ordinance was to <br />tie in with the way the Liquor Licenses are <br />issued to keep the requirement uniform.
