Roll call vote: <br />Ferrera Yes <br />Leary Yes <br />Meier Yes <br />Morris Yes <br />Fauson Yes <br />Cummings Yes <br />Cussen Yes <br />Motion carried unanimously. <br /> <br />Mayor and councilmembers had been provided <br />a memo by Attorney Rautenstraus and felt he <br />didn't have anything further to add unless <br />Council wished to discuss this. <br /> <br />Commented that somewhere in the memo he had <br />stated that we would probably be opposed in <br />seeking such a judgement by the landowner or <br />other parties, Neodata, for example. <br />Attorney Rautenstraus advised that would be <br />a presumption on his part. <br />Leary further commented they would be opposing <br />the concept of seeking a judgement; we would <br />be in agreement on how we argued our side of <br />the issue. We would be arguing the City is <br />taking in terms of what we feel that that is <br />a use in accordance with the zoning ordinances. <br />So, we wouldn't be opposing each other on that <br />issue. <br />
