Planning Commission <br />Meeting Minutes <br />July 14, 2022 <br />Page 3 of 8 <br />• The area to be rezoned is rezoning from a commercial land use to a land <br />use that includes residential, and the property owner elects to permanently <br />deed restrict 30% of the new residential units on site as affordable <br />housing. For the purposes of this subsection: <br />• "Rezoning" also includes approval of any amendment under the <br />City's zoning code that would increase the area of a property on <br />which residential uses are allowed or increase the number of <br />residential units, to the extent of such increase. <br />Staff notes that approval of this ordinance does not change the existing Comprehensive <br />Plan and Small Area Plan policies for rezoning of a property to allow residential <br />development. Amendments to the applicable Plan would be required as part of the <br />process. <br />Staff Recommendations: <br />Staff is recommending approval of Resolution 8, Series 2022, recommending approval <br />of the draft ordinance. <br />Commissioner Questions of Staff. <br />Moline says because the GDP already has some residential component, would it only <br />apply to the areas of the GDP that would be re -zoned from commercial? <br />Ritchie says that it applies to the number that is being increased. The increment is <br />subject to the 30% requirement. The existing entitled land areas stay at 12%. <br />Moline asks if this could apply to a geographic area or special areas or would it apply to <br />the numbers as a whole? <br />Ritchie says it may apply to a geographic area. It could also apply if it is only for an <br />allocation of additional residences within an existing, entitled land area. GDP's are <br />always pretty nuanced. <br />Moline asks if we are at risk of reducing the amount of housing that could be proposed <br />for these types of areas. <br />Ritchie says staff would have to do additional local studies to better understand if this <br />would be a barrier. It might be property -to -property specific though. <br />Moline asks if staff can better clarify the timing of the adoption of this. <br />Ritchie say City Council included this on their summer work plan and the housing study <br />is intended to begin late this year. <br />Osterman asks if the local feasibility analysis will be included in the housing study. <br />Ritchie says staff has not developed the entire scope but they hope to include it. <br />Krantz asks if staff knows what the city's capacity is for growth in population. <br />Zuccaro says we do not have a residential cap. <br />Brauneis mentions that the "30% of dwelling units" seems like an undefined number of <br />units. He asked how that is calculated. Do they have to be certain types of houses? <br />Ritchie says that the form and shape of dwelling units can greatly vary. It can be any of <br />the type of units that exist and allowed by code. <br />Brauneis asks who determines the current price of that unit and sold at that price. <br />Ritchie says the city is still developing those procedures. <br />Zuccaro says it is possible that the City will defer to an Intergovernmental Agreement <br />between the city and surrounding jurisdictions to administer portions of the program for <br />the city. <br />
