RESOLUTION NO. 38 <br />SERIES 2022 <br />A RESOLUTION CONDITIONALLY APPROVING A TWELVE MONTH -LONG <br />TEMPORARY USE AS A PRECURSOR TO A PERMANENT USE TO ALLOW <br />CONSTRUCTION AND OPERATION OF AN OUTDOOR BEER GARDEN <br />ASSOCIATED WITH THE ROCKY MOUNTAIN TAP AND GARDEN LOCATED AT <br />1077 COURTESY ROAD. <br />WHEREAS, there has been submitted to the Louisville Planning Commission an <br />application for a nine month -long Temporary Use as a Precursor to a Permanent Use to <br />allow construction of an outdoor beer garden associated with Rocky Mountain Tap and <br />Garden at 1077 Courtesy Road; Lot 1, DELO Plaza Subdivision; and <br />WHEREAS, City staff has reviewed the information submitted and found that, with <br />the two conditions, the application complies with the Louisville zoning regulations and <br />other applicable sections of the Louisville Municipal Code; and <br />WHEREAS, the Planning Commission considered the application at a duly noticed <br />public hearing on August 11, 2022 where evidence and testimony where entered into the <br />record and the Planning Commission voted 6-0 in favor of recommending approval with <br />two conditions. <br />1. Execute the Restoration Agreement prior to City Council public hearing. <br />2. Submit a complete PUD Amendment application. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado does hereby approve a twelve month -long Temporary Use Permit <br />as a Precursor to a Permanent Use to allow construction and operation of an outdoor <br />beer garden located at 1077 Courtesy Road with the following two conditions: <br />1. Temporary Use Permit shall not be issued until city receives the Restoration <br />Agreement and financial surety. <br />2.
