SUBJECT: STUDY SESSION — ACCESSORY DWELLING UNITS <br />DATE: NOVEMBER 7, 2022 PAGE 4 OF 8 <br />percent of properties within certain zone disticts that are allowed to have ADUs. The <br />image below is from a City of Boulder presentation demonstrates how this concept <br />works, where no more than 20% of parcels within a 300-foot radius of a proposed ADU <br />may have ADUs. Exceptions are available when affordable housing is provided or the <br />property is historic and landmarked. These concepts are discussed in more detail <br />below. <br />While overcrowding in neighborhoods is a common concern when concidering whether <br />a community will allow ADUs, it is rare for neighborhoods to become oversaturated with <br />ADUs. This may be due to difficulty getting loans for the development of ADUs and <br />some property owners not wanting to have a second unit on their property. <br />Example City of Boulder restriction on percent of ADUs within 300-foot radius <br />Proposed ADU <br />0 300-foot Radius <br />F1Parcels within 300-foot Radius <br />Legal Nonconforming Structures <br />Accessory Dwelling Unit <br />*Proposed ADU is 1ncfuded in calculation <br />Owner occupancy requirements: <br />Most regulations will require the property owner to occupy the property as a primary <br />residence, either in the principal residence or ADU. This helps to ensure the property is <br />maintained well and that properties with ADUs do not become predominately owned by <br />investors. A notable exception is the City of Lafayette, which does not have an owner - <br />occupancy requirement and also allows sale and ownership of the ADU separate from <br />the principal dwelling as long as the ADU has it's own water and sewer service. <br />Occupancy limitation for ADUs: <br />The City of Louisivlle limits occupancy of a dwelling unit to a family as defined by the <br />zoning code, or no more than two unrelated persons. Many ADU codes have separate <br />occupany limits of either two or three individuals in the ADU in additoin to the <br />occupancy of the princippl dwelling. Some regulations do not make an exception for <br />CITY COUNCIL COMMUNICATION <br />5 <br />
