<br />AN ORDINANCE APPROVING THE VACATION OF TWO FIVE-FOOT SURFACE MMNTENANCE
<br />EASEMENTS, A 30' WIDE CITY EXCLUSIVE UTILITY EASEMENT AND A 10' WIDE UTILITY
<br />EASEMENT, DEDICATED BY THE PLATS OF LOUISVILLE TRADE CENTER AND DELO LOFTS
<br />WHEREAS, by Inc pat of Delo Lofts, recorded in the Office of the Boulder County Clerk
<br />and Recorder on June 29, 2017 at Reception No. 03600743, there was dedicated to the City two
<br />5400t wide surface maintenance easements, a 30-foot wide city exclusive utility easement, and a
<br />20-tu01 wale private utility easement for such Subdivision in the location further descn0ed in Exhibit
<br />A a]acned hereto: and
<br />WHEREAS, by the plat of Louisville Trade Center, recorded in the Office of the Boulder County
<br />Clerk and Recorder on August 7, 1984 at Reception No. 838267, there was dedicated to the City a
<br />10 toot utility easement on Lot 101 of such subdivision b the location fencer described in Exhibit
<br />A attached hereto: and
<br />WHEREAS, a Real Panned Unit Development and Subdivision Plat application have
<br />been approved by the City for re -subdivision of property encumbered by the above referenced
<br />easements under the name Deb Lolls Subdivision Amendment 1: and
<br />WHEREAS, the City Council finds and determines that vacation of the easements for which
<br />vacation is requested is not and will nM be needed for any pu8in governmental or utility purposes;
<br />and
<br />WHEREAS, the City Council desires to approve the application and vacate the ciy9 interests
<br />in the easements for which vacation n requeste0;
<br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCA OF THE CRY OF LOUISVILLE,
<br />COLORADO:
<br />Section 1. The City hereby approves the vacation of the certain 6 foot wide surface
<br />rnaintenance easements, the 10 foot wide dirty easement and the 30 foot wide city exclusive Nilny
<br />easement. which easements herein vacated is in the locations further described in Exhibit A attached
<br />hereto and incorporated herein by tits reference.
<br />Section 2. All other ordinances or portions thereof Inconsistent or in conflict with this
<br />ordinance or any nodule hereof are repealed to the extent of such inconsistency or conflict
<br />Sepbn 3. The Mayor and City Manager, or either of them, is authorized to execute such
<br />additional documents as maybe necessary to evidence the vacation easements herein vacated,
<br />including but not execution of quit claim deeds.
