She would like to understand better and have more guidance on setbacks and <br />building codes in regards to the rebuild process. <br />Mark Oberholzer, 224 Hoover Ave <br />Oberholzer comments on the virtual meeting and how it is not clear how many people <br />are listening or tuning into the meeting. <br />NEW BUSINESS — PUBLIC HEARING ITEMS <br />A. Zoning Administrator Authority for Properties Affected by Marshall Fire: A <br />request for approval of an emergency ordinance addressing zoning regulations affecting <br />structures damaged or destroyed by the Marshall Fire and authorizing the Zoning <br />Administrator to reconcile discrepancies to facilitate rebuilding of the same. (Resolution <br />No. 2, Series 2022). <br />• Applicant: City of Louisville <br />• Case Planner: Rob Zuccaro, Director of Planning and Building Safety <br />All notice was met as required and there is no commissioner conflict of interest. <br />Staff Presentation: <br />Zuccaro mentions that 15 neighborhoods/subdivisions were impacted by the fire. The <br />purpose and benefits of the Zoning Administrator would include the following: <br />• Issuing a summary of standards that reflect existing standards when available and <br />clear, and provide determinations to clarify or fill in gaps of code. <br />• Allowing Minor Impact Variances with an expedited process. <br />• Allowing determinations to be appealed to the Board of Adjustment. <br />The proposal is for adoption as an Emergency Ordinance allowing immediate <br />application and allows homeowners to continue and complete their design process as <br />soon as possible. <br />He also gives examples of potential issues: <br />• Conflicts in as -built lot coverages and underlying zoning standards <br />• Omissions or conflicts in street side -yard setbacks and underlying zoning <br />standards <br />• Omissions in GDP standards for building heights <br />• Height calculation methodology for walk out basements <br />• Fencing design standards <br />• Lot orientation based on shape of lot <br />Staff Recommendations: <br />Staff recommends approval of Resolution 2, Series 2022, which is an emergency <br />ordinance addressing zoning regulations affecting structures damaged or destroyed by <br />
