Part of Phillips 66 Rural District, includes policies on density (0.25 FAR), <br />limits height to three stories but promotes clustering of buildings in <br />exchange for height, supports retail, office, industrial, and institutional <br />uses. <br />b. The General Development Plan provides setback and parking standards <br />and requires Commercial Development Design Standards and Guidelines <br />(CDDSG) compliance, and was applied at PUD review stage. <br />3. Whether the proposed subdivision will promote the purposes set forth in section <br />16.04.020 of this Code and comply with the standards set forth in chapter 16.16 <br />of this Code and this title. <br />a. Section 16.04.020 includes 19 specific purpose statements <br />b. Chapter 16.16 provides subdivision design standards <br />i. General design and construction <br />ii. Site considerations <br />iii. Streets, alleys and easements <br />iv. Blocks <br />v. Lots <br />vi. Public sites and dedications <br />The PPLAB reviewed this on May 5, 2022 and recommended approval. The OSAB <br />reviewed this on May 11, 2022 and June 8, 2022 and recommended approval with the <br />following conditions: <br />■ Legal commitment to rehabilitate and dedicate Paradise Lane properties <br />■ Follow City standards for underpass design <br />■ OSAB participation in PUD review process <br />■ Consider 3rd underpass at Rockress Drive/NW Parkway <br />Staff Recommendations: <br />Staff recommends approval with the following conditions: <br />• Prior to recording the final plat acquiring all necessary right of way <br />• Address in the Subdivision Improvement Agreement <br />o License agreements for maintenance of drainage on city property <br />o Sewer plant expansion trigger/development cap <br />o Maintenance of Tract L as private common open space <br />o Paradise Lane properties dedication to the city <br />o Underpass design <br />• Update TDM Plan and address Metro District obligations <br />• Written approval from Xcel on use of easements <br />• Update plat labeling <br />• Add note on Tract Summary Table noting Tracts C, D and I are dedicated for open <br />space <br />• Adjust Tract K dimensions to accommodate the sewer lift station <br />• Label Tract L on plat as common open space owned by Metro District <br />Commissioner Questions of Staff. - <br />Howe asks if staff can highlight the major changes from the previous overturned <br />ordinance and this one. <br />
