City Council <br />Meeting Minutes <br />September 20, 2022 <br />Page 7 of 11 <br />Councilmember Brown asked why the applicant was able to complete the existing <br />improvements without a permit. Kay Marchetti stated the applicant has been working <br />with the City on this site for quite a while and the applicant was unaware they could not <br />make these changes without a permit. Staff issued a stop work order and the applicant <br />has now been working with staff on this plan and is working on a restoration agreement <br />for the site as well. Staff feels the applicant is working in good faith and this is an <br />appropriate way forward. Director Zuccaro added that staff tries to work with applicants <br />to bring properties into compliance when work is done without appropriate approvals. <br />Mayor Maloney asked if the parking requirements are met with this new use. Key <br />Marchetti stated this will be addressed in the PUD process. <br />Councilmember Most stated she was concerned that the applicant installed <br />improvements prior to receiving a permit. Mayor Stolzmann stated she could <br />understand how the confusion could have happened. <br />Mayor Stolzmann stated she would prefer to have one set of noise rules that apply to all <br />businesses rather than dictating it for individual businesses as it makes it difficult to <br />enforce. <br />Public Comments <br />Mike Deborski, resident and nearby business owner, urged Council to approve the <br />application stating it is good use of the space and is a good upgrade to the space. <br />Mayor Pro Tern Maloney supports the application and stated it is a good use of the <br />space. <br />MOTION: Mayor Pro Tern Maloney moved to approve the application with the <br />conditions outlined by staff; Councilmember Leh seconded the motion. <br />Councilmember Brown stated even with some issues with the process this is a good <br />use of the space and he supports the application. He feels it meets the code. <br />Councilmember Leh agreed. <br />Mayor Stolzmann made two friendly amendments: 1) to remove the amplified sound <br />restrictions and 2) to allow the permit to last for 12 months; both were accepted by <br />Mayor Maloney and Councilmember Leh. <br />Councilmember Brown stated he would prefer the staff recommendation on the sound <br />regulations. <br />Mayor Stolzmann closed the public hearing. <br />
