<br />City Council <br />Meeting Minutes <br />July 7, 2009 <br />Page 7 of 11 <br /> <br />RESOLUTION No. 25, SERIES 2009 - A RESOLUTION APPROVING <br />PARBOIS PLACE FINAL SUBDIVISION PLAT AND FINAL PLANNED UNIT <br />DEVELOPMENT <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Planning Director Wood explained the applicant, ACME Terrace LLC, <br />represented by Mr. Garrett Mundelein, has submitted final documents initiating a <br />land use request for a Final Subdivision Plat and a Final PUD Development Plan. <br />The total land holdings of the three ownership parcels is 1.2 acres and is located <br />on the southwest corner of County Road and Elm Street with frontage on Elm <br />Street and County Road. The subject property is zoned RM and is subject to the <br />Old Town Overlay District. The applicant is requesting authorization of the <br />required land-use entitlements to plat three ownership parcels into a six lot <br />subdivision for residential development. The development proposal is consistent <br />with conditions established by both Planning Commission and City Council <br />during the preliminary plat and PUD review. The density has been reduced to a <br />total of 15 units (10 townhome units and 5 single family units). In review of the <br />final subdivision plat staff focused on an analysis of the public-use dedication, the <br />provision of flood plain development, and access. <br /> <br />Public-Use Dedication: Section 16.16.060 of the Louisville Subdivision Code <br />requires upon the initial subdivision of a parcel the subdivider dedicate to the City <br />a minimum of 12% of the land for non-residential land uses and 15% for <br />residential land uses for the use of parks, schools and other public uses. It was <br />the position of staff, as affirmed by the City Attorney's office; the Parbois <br />Subdivision Plat is required to create and dedicate lots, tracts, or parcels and <br />therefore constitutes a subdivision of the property. Staff worked with the <br />applicant and developed a methodology to calculate a fee in-lieu of land in the <br />amount $9,738. <br /> <br />100 Year ReQulatorv Floodplain: The northerly portion of the subject property <br />(portion of Lots 3 and 5, and all of Lot 4) is currently within the AH Flood <br />Designation Zone within the 100 year flood district. A flood plain development <br />permit was approved by the Board of Adjustment on July 11,2007. In <br />accordance with the conditions of approval of the Flood Plain Development <br />Permit, a certified elevation certificate shall be submitted for each building after a <br />foundation pour and a second elevation certificate prior to issuance of a <br />certificate of occupancy. <br /> <br />Access: In response to Section 17.12.050 (G) of the Old Town Overlay District, <br />the Planning Commission conditioned its preliminary approval on the requirement <br />that the PUD and plat be revised to incorporate an access to County Road. The <br />access to County Road has been incorporated into the attached development <br />plan. The internal driveway has been dedicated as a 20' access easement on the <br />
