<br />LIQUOR LICENSE <br />JAYCEES cont'd <br /> <br />PUBLIC HEARING <br />CONTINUATION HOUSE <br />BILL 1041 - DESIGNATING <br />MATTERS OF STATE INTEREST <br /> <br />Seconded by Councilman Berry. Councilman Domenico <br />stated that he could not vote yes on the approval <br />without having a clarification by Paul as to <br />whether this was legal or not. With no more <br />remarks, Mayor Waschak called for roll call vote. <br />Domenico no, Berry yes, Caranci yes, Dhieux yes, <br />DelPizzo yes. Motion carried. <br /> <br />Mayor Waschak opened the Public Hearing contin- <br />uation on HB 1041 Designating Hatters of State <br />Interest which began on June 25, 1975. <br />Mr. Wurl stated that Mr. Dennis Drumm was in <br />attendance to make the presentation. <br />Mr. Drumm read and reviewed the Recommendations <br />Pertaining to HB 1041 Identification, Desig- <br />nation and Administration. <br />During the review Mr. Drumm stated that on <br />July 25, 1975, there was a public hearing held <br />by - the Land Use Commission on their guidelines. <br />Mr. Drumm stated that the statue gave theLUC the <br />responsibility to prepare guidelines and they will <br />be law by virtue of the fact the statute assigned <br />the LUC that responsibility. <br />He also stated that LUC did adopt the document, <br />however there were many changes and there has <br />not been a final publication of the adoption from <br />the public hearing. <br />He stated that the guidelines will become official <br />possibly by the end of August after reviewed by <br />the Attorney General of the whole set of guidelines. <br />Mayor Waschak asked Mr. Drumm to explain what was <br />meant by the sentence stating that Louisville will <br />have greater flexibility in implementation of <br />HB 1041 related land use controls than was <br />originally anticipated. <br />Mr. Drumm stated that the LUC was holding to <br />the position that HB 1041 would be used for all <br />matters of state interest, however now they state <br />that there are others means of control such as <br />other statutes, P.U.D. etc. <br /> <br />Councilman DelPizzo asked Mr. Drumm about how <br />the County could come up with decisions about <br />subsidence when they have not personally made <br />any tests but are going by maps that they have. <br />Mr. Drumm stated that Mr. White attended a public <br />hearing. He stated that no guidelines have been <br />adopted and that the county is just designating, <br />so what they have done is place a moratorium <br />on all development until they get their guidelines. <br />
