<br />Mayer moved that Council approve Resolution No. 38, Series 1998 - Amendment to the <br />Amended Final PUD Development Plan for Conoco on Lot 7 of Centennial Valley Parcel 0, <br />Filing 3 with the Planning Commission amendments, seconded by Sisko <br /> <br />Davidson offered a friendly amendment to condition number four to add a comma after the word <br />'glare,' and insert "or such other fixture that would accomplish the same," agreed to by Mayer <br />and Sisk. <br /> <br />Keany offered a friendly amendment as condition number five, that a photometric plan before <br />and after alterations would be provided to staff, agreed to by Mayer. <br /> <br />Sisk offered a friendly amend~ent to include when the plan would be submitted and that it <br />would be subject to significant reduction of the onsight lighting and staffs approval, agreed to by <br />Mayer. <br /> <br />Roll call was taken. Motion passed by a 6-0 vote. <br /> <br />RESOLUTION No. 39, SERIES 1998 - A RESOLUTION APPROVING A PURCHASE <br />CONTRACT TO BUY & SELL VACANT REAL EST ATE, WATER RIGHTS, AND <br />CONSERVATION EASEMENT (Published Louisville Times 7/11/98) <br /> <br />Davidson called for staff introduction. <br /> <br />B\ll Simmons, City Administrator, stated that, pursuant to Section 2.92.010 of the Louisville <br />Municipal Code, a contract is to be made and entered into by and between the City of Louisville, <br />the Councy of Boulder, and Klubert \Varembourg and Helen Rose Warembourg (the "Sellers") to <br />sell to the City: <br />a. Fee simple estate, in and to a tract of land containing approximately 220 acres <br />(referred to as Parcell) and including all oil, gas, and other minerals in and under <br />that may be produced from the parcel. <br />b. Fee simple estate, in and to the following water rights applicable to Parcell <br />which include one hundred shares of the Goodhue Ditch and Reservoir Company, <br />six shares of the capital stock of the Farmers Reservoir and Irrigation Company, <br />well and well rights under the Warembourg #1 Well bearing Colorado Division of <br />Water Resources Permit No. 74099 and all other surface and subsurface water, if <br />any, attached to Parcell and owned by the Sellers. <br />c. A conservation easement containing approximately 72 acres (referred to as Parcel <br />2), over and across the following water rights applicable to Parcel 2 which include <br />17.295 shares ofthe Goodhue Ditch and Reservoir Company, one share of the <br />capital stock of the Fanners Reservoir and Irrigation Company, and all wells and <br />well rights under the W'arembourg #2 and #3 Well bearing Colorado Division of <br />Water Resources Nos. 1 2974R and RN 346. <br /> <br />13 <br />
