in the city. All parking improvement fees paid and collected in accordance with <br />Section 17.20.025 shall be paid into the Fund. The Fund shall be an interest-bearing <br />account of the city. The Fund account may be within existing funds of the city, <br />provided that amounts within the Fund account are accounted for separately and that <br />the aggregate amount of collected parking improvement fees is clearly identified. <br />Any interest income earned on parking improvement fees shall be credited to the <br />Fund. The treasurer shall account separately for all receipts and disbursements to <br />and from the Fund and shall not commingle any part of the monies in such Fund <br />with other funds of the city. <br /> <br />3.16.080 Downtown Parking Improvement Fund Use. <br /> A. Any and all disbursements from the Downtown 'Parking <br />Improvement Fund ("Fund") shall be limited to the following uses determined by <br />the City Council to be reasonably necessary to respond to and assist in defraying the <br />costs of parking needs created by new development within Downtown Louisville <br />which is subject to the fee: <br /> 1. Acquisition, construction, improvement, and provision of additional <br />on-street and off-street public parking spaces to serve Downtown Louisville; <br /> 2. Grading; installation of curb, gutter, and pavement; construction of <br />drainage improvements; and the installation of lighting, landscaping, trash <br />receptacles, outdoor seating, bike racks and similar facilities, in association with the <br />acquisition, construction, improvement or provision of additional on- and off-street <br />public parking space to serve Downtown Louisville; <br /> 3. Purchase or lease of real and personal property for the construction, <br />improvement, or provision of additional on-street and off-street public parking space <br />to serve Downtown Louisville; <br /> B. A portion of the parking improvement fee collected may be used to <br />help defray the administrative expenses of the DePartments of Finance, Parks and <br />Recreation, Community Development, Public Works and City Administration <br />reasonably incurred in connection with and equitably apportioned to acquisition and <br />construction of improvements pursuant to this Section and the cost of accounting <br />and management of the parking improvement fee and Fund, with such portion of the <br />fee being deposited into the appropriate fund of the City to help defray such <br />expenses. <br /> C. The city administrator may from time to time establish written <br /> administrative regulations to facilitate the implementation of this section and related <br /> sections of this Code concerning the Downtown Louisville parking improvement <br /> fee. Such regulations shall be consistent with the purposes and provisions of this <br /> chapter and related sections of this Code. <br /> <br /> Section 5. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br /> <br /> <br />
