3.1 Use of the Property in a manner inconsistent with the <br />spirit and purposes stated herein. <br /> <br /> 3.2 The change, disturbance, alteration, or impairment of <br />the open space values and the agricultural resources of the <br />Property except as otherwise provided herein. <br /> <br /> 3.3 Those uses which are otherwise consistent with the <br />applicable zoning regulations as they apply to the Property but <br />which are not specifically permitted by this Easement. Those <br />uses permitted by Article 4 (A-Agricultural District) and Article <br />20 (Uses Permitted By Special Review) of the Boulder County <br />Zoning Resolution are specifically prohibited by this Easement, <br />unless otherwise provided herein. Those uses permitted by right <br />or special review in the City of Louisville's designation for the <br />Property, if the Property is annexed to the City, are also <br />specifically prohibited by this Easement, unless otherwise <br />provided herein. <br /> <br /> 3.4 Any use not expressly permitted by the applicable <br />zoning regulations for the Property, except as described in <br />Section II. <br /> <br /> 3.5 The construction, placing, or erection of any signs or <br />billboards except those needed for the uses permitted herein. <br /> <br /> 3.6 Notwithstanding the Northwest Parkway I.G.A., the <br />construction, reconstruction or replacement of any structures, or <br />development (residential or otherwise) of the Property, is <br />specifically prohibited. <br /> <br /> 3.7 The dumping, accumulation or storage of ash, trash, <br />junk, rubbish, sawdust, garbage, chemicals, or other unsightly or <br />offensive material, or changing of the topography through <br />dredging or filling, or the placing of soil or other substances, <br />material, or landfill on the Property, except as provided in <br />Paragraph 2.3. <br /> <br /> 3.8 The setting of any fire, controlled or uncontrolled, <br />except for normal and customary burning of irrigation ditches and <br />agricultural burns, such as soil conservation approved burning of <br />weeds. Grantor agrees to make a reasonable effort to control and <br />then suppress any permitted burn and to suppress any other fire <br />that may occur on the Property including, but not limited to, <br />notifying the appropriate fire district. <br /> <br /> 3.9 Any division of the Property (whether or not a <br />subdivision as defined by state law, and whether or not the <br />division is legal or physical) without the express written <br /> <br />Bowes Exchange Agreement l l <br /> <br /> <br />
