EXHIBIT A <br /> <br /> Approximately 66 acres located in the N1/2 of the NWl/4 of <br />Section 20, and the NE1/4 of the NE1/4 of Section 19, Township 1 <br />South, Range 69 West of the 6th P.M., County of Boulder, State of <br />Colorado, as approximately shown on Exhibit B of the Contract. <br />The exact legal description of Parcel 1 shall be determined prior <br />to closing, after a survey has been completed, and Parcel 1 shall <br />be referred to as "Parcel 1 as shown on the Division of Land Plat <br />of the Bowes Properties Limited Partnership Property recorded on <br /> in Plan File No. at Reception No. <br /> in the Office of the Boulder County Clerk <br />and Recorder" when the Division of Land Plat is filed. <br /> <br />TOGETHER WITH the following water rights: <br /> <br />One share of the capital stock of the South Boulder and Coal <br />Creek Irrigating Ditch Company, one share of the capital stock of <br />the South Boulder and Coal Creek First Extension Ditch Company, <br />and two shares of the capital stock of Farmers Reservoir and <br />Irrigation Company, a/k/a/ Farmers Lake (Marshall Lake Reservoir <br />Division), together with (1) all surface and subsurface water and <br />historical water rights attached to or appurtenant to or used in <br />connection with the Property; and (2) all irrigation ditches, <br />ponds, laterals or shares in lateral companies, diversion boxes <br />and similar irrigation structures located on the Property or <br />located off the Property and used to convey water yielded from <br />the above-described water shares to the Property. <br /> <br />Bowes Exchange Agreement 16 <br /> <br /> <br />
