PARTIAL RELEASE OF AGREEMENT THIS PARTIAL RELEASE OF AGREEMENT is made effective this day of .. ,2001 by the City of Louisville, a Colorado municipal corporation whose address is 749 Mai~ Street, Louisville, Colorado 80027 (the "City"), unto and in favor of the Northwest Parkway Public Highway Authority, a body politic and corporate under the laws of the State of Colorado, whose address is 555 Eldorado Boulevard, Suite 130, Broomfield, CO 80021 (the "Authority"). WHEREAS by the Agreement between the City of Louisville and M.D.C. Corporation and Boulder County Land Venture dated March 22, 1983 (the "Agreement") and recorded in the records of Boulder County at Reception No. 549586, M.D.C. Corporation and Boulder County Land Venture agreed to be bound by certain obligations with respect to lands described in the Agreement; and NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City hereby does remise and release unto the present owner or owners of the real property described in Exhibit A, attached hereto and incorporated herein by reference, and unto the heirs, successors and assigns of such owner or owners forever, all the right, title and interest which the City has under and by virtue of the Agreement in that portion of the real property described in Exhibit A.
