He further advised present ordinances <br /> do not require subdivision of any ground.be- <br /> fore development takes place. They have <br /> proceeded in that direction to amend the code <br /> to include in the annexation agreement that <br /> we get a cooperation for them to sub-divide. <br /> The BSCS property has indicated that willing- <br /> ness. So in effect, they are bound by the <br /> annexation agreement to subdivide the property, <br /> but if the City code was applied, they could <br /> proceed with no subdivision under the present <br /> code, if there wasn't an annexation agreement <br /> that bound them to the subdivision process. <br /> Neodata has indicated a willingness to pro- <br /> ceed with that portion of the annexation <br /> agreement of the subdivision process, and <br /> at the same time are requesting that they <br /> be given permission from Council to pro- <br /> ceed with the building expansion, which <br /> will take several months to finalize. <br /> The subdivision process will take approxi- <br /> mately 3 months, and in view of that time <br /> frame, it was his opinion they were viewing <br /> some avenues to pursue enabling them to <br /> proceed with building plans while they are <br /> subdividing the property. Rupp further ad- <br /> vised it was not unusual for developers or <br /> property owners to bring requests of this <br /> kind to Council for consideration. Each <br />
