411 4/6/82 Page -3- Mayor Mier Inquired of Mr. Burgghardt if Neodata would be agreeable to working with the City if and when, after engineering traffic studies are complete, on some type of signaali:ation of South Boulder Road at their site. Mr. Kurt Burghardt Informed council of course they would be willing to cooperate with this to improve the flow of traffic to help the City and the employees. Councilman Leary Inquired of Director Rupp for an explanation of what the request is what Council would be varying from in terms of procedure, etc. Director Rupp advised that in the annexation agreement there is a stipulation that the City has requested that all property owners when they do annex, - - that they do sub-. divide. He further advised present ordinances do not require subdivision of any ground.be- fore development takes place. They have proceeded in that direction to amend the code to include in the annexation agreement that we get a cooperation for them to sub-divide. The BSCS property has indicated that willing- ness. So in effect, they are bound by the annexation agreement to subdivide the property, but if the City code was applied, they could proceed with no subdivision under the present code, if there wasn't an annexation agreement that bound them to the subdivision process. Neodata has indicated a willingness to pro- ceed with that portion of the annexation agreement of the subdivision process, and at the same time are requesting that they be given permission from Council to pro- ceed with the building expansion, which will take several months to finalize. The subdivision process will take approxi- mately 3 months, and in view of that time frame, it was his opinion they were viewing some avenues to pursue enabling them to proceed with building plans while they are subdividing the property. Rupp further ad- vised it was not unusual for developers or property owners to bring requests of this kind to Council for consideration. Each
