. 411
10/19/82 Page -S-
Steve Ystchak Mr. Yatchak stated that he was president
1091 Azure Way of MCIC, which is the corporation of home-
owners that was recently involved in the liti-
gation against the City for zoning violation.
He was certain that everyone was aware of the
recent decision by the Court. He wished to
caution the council and the City with undue
optimism. As he saw it, and wanted to stress,
that this decision did not favor the City' s
interpretation of zoning code use. Instead
what it did do was to establish the road map
under which the Mesa residents may preserve
environment and bring this injustice to an
inevitable conclusion. He wished to add it
is very infrequent in our daily lives that
we have the ability to rectify mistakes that
we have made in the past . Council is very
fortunate, in his opinion, they have an op-
portunity this evening. He stated they can
still say yes to the people, by saying no
to the industrial revenue bonds. He asked
that they send a message to the people, for
the people , as representatives of the people;
reverse the normal 5-2 , or 4-3 customary vote
from the quick buck to individual human rights,
and preservation of people's daily lives .
ADOPTION OF ORDINANCE #774 Councilman Cummings moved, Councilman Ferrera
seconded Ordinance #774 - A. C. Nielsen Co.
Industrial Revenue Notes be adopted.
Counciman Leary Commented that he was not certain that the
options Mr . Yatchak gave Council were the
only options, felt perhaps Council has another.
Asked Attorney Rautenstraus to summarize what
the Court ruling on the litigation was.
Attorney Rautenstraus Replied he could summarize the ruling now,
if Council so wished, would do it in writing,
or a special meeting.
Councilman Leary requested this be done now.
Attorney Rautenstraus advised that on the
issues that had been before the Court , the
Judge ruled that for those issues the Corpora-
tion did not have standing and that the law
suit was filed prematurely.
Councilman Leary requested that Attorney
Rautenstraus comment on the road map comment
made by Mr. Yatchak.
