11/3/82 Page -6-
Council was not trying to put people out of
business.nor discourage familiea_fr a playing the
video games - this ordinance was initiated for
children that cannot drive to Lafayyette. Boulder,
etc. , who can cut school classes, become
additive and steal to get a quarter to play
the games - national studies prove that they do.
He would not be willing to negotiate a fee
other than the one stated in the ordinance.
Mrs . Carol Kelly Stated some of the children come to the arcade
during their lunch break or after school . It
was her opinion there were not that any
students cutting classes to come to the arcade.
Councilman Cummings commented perhaps Mrs.
Kelly was correct; but this is the question
that was being addressed by council.
Mayor Meier Commented some of the original figures that
council was considering when the fees were inititated
were as a result of a conversation he had
regarding video game machines. He had since
reviewed some of the aspects of video games
further and would be willing to reduce the
fee to $50 per machine. Mayor Meier also
felt that the ordinance was not written for
the fee alone and agreed with Councilman Cum-
mings about the other concerns .
Mayor Meier closed the public hearing.
Amendment to the Ordinance Councilwoman Morris moved. Councilman Leary
Hours seconded that Ordinance #767 be amended under
section 8.48.070 to read "shall not be open
for operation between the hours of midnight
and 8 :00 o.clock a.m." Question calledr.
6 Ayes - 1 Nay - Councilman Cummings dissenting.
Second Amendment to Mayor Meier moved the fee be changed from
Ordinance p767 $100 per machine to $50 per machine.
Motion defeated - no second to motion.
Councilman Cussen moved. Councilman Leary
seconded that the fee be changed to $75 per
machine in lieu of $100.
Councilman Fauson Commented he sympathized with Mrs. Kelly' s
concerns about the fee , since the business is
their livelihood; however there are establish -
tents within the City that can afford the
larger fee.
