Roll call vote : <br /> Ferrera Yes <br /> Leary Yes <br /> Meier Yes <br /> Morris Yes <br /> Fauson Yes <br /> Cummings Yes <br /> Cussen Yes <br /> Motion carried unanimously. <br /> DECLARATORY JUDGEMENT Mayor and councilmembers had been provided <br /> a memo by Attorney Rautenstraus and felt he <br /> didn' t have anything further to add unless <br /> Council wished to discuss this . <br /> Councilman Leary Commented that somewhere in the memo he had <br /> stated that we would probably be opposed in <br /> seeking such a judgement by the landowner or <br /> other parties , Neodata, for example. <br /> Attorney Rautenstraus advised that would be <br /> a presumption on his part . <br /> Leary further commented they would be opposing <br /> the concept of seeking a judgement; we would <br /> be in agreement on how we argued our side of <br /> the issue. We would be arguing the City is <br /> caking in terms of what we feel that that is <br /> a use in accordance with the zoning ordinances. <br /> So, we wouldn't be opposing each other on that <br /> issue. <br /> • <br />
