<br />circumstances is held invalid, such invalidity shall not affect
<br />other provisions or applications of this Ordinance which can be
<br />given effect without the invalid provisions or application, and to
<br />this end the provisions of this Ordinance are declared to be
<br />severable. Specifically, but not by way of limitation, the
<br />provisions hereof concerning the Use Tax are severable from the
<br />Sales Tax.
<br /> Section 18. Repealer.
<br /> (a) If this Ordinance is approved at a special
<br />municipal election to be held on March 21, 1989, the provisions of
<br />the 1975 Sales Tax Ordinance and all other acts, orders,
<br />resolutions, ordinances, or parts thereof, of the City that are
<br />inconsistent or in conflict with this Ordinance, shall be repealed
<br />to the extent only of such inconsistency or conflict, such repeal
<br />to be effective as of July 1, 1989.
<br /> (b) If this Ordinance is not approved at a special
<br />municipal election on March 21, 1989, or does not for any reason
<br />become effective on July 1, 1989, the provisions hereof shall have
<br />no forc~ or effect, and the 1975 Sales Tax Ordinance and all other
<br />acts, orders, resolutions, or ordinances of the City shall
<br />continue to be effecti ve as if this Ordinance was never adopted.
<br />The repeal of the 1975 Sales Tax Ordinance and of any acts,
<br />orders, resolutions, ordinances, or parts thereof by the terms
<br />hereof shall not have the effect of releasing, extinguishing,
<br />altering, modifying, or changing, in whole or in part, any
<br />penalty, forfeiture, or liability, either civil or criminal, which
<br />was incurred thereunder prior to such repeal, and the 1975 Sales
<br />Tax Ordinance and such acts, orders, resolutions, ordinances, or
<br />parts thereof shall be deemed and held to be in full force and
<br />effect for the purpose of sustaining any actions, suits,
<br />proceedings, and prosecutions, either civil or criminal, for the
<br />enforcement of such penalty, forfeiture, or liability, as well as
<br />for the purpose of sustaining any judgment, decree, or order which
