wanush explained that a letter and petition from the 1007 Corporation was received requesting the annexation of approximately 9.9 acres of land. This land is located in the southwest quadrant of Dyer Road and old McCaslin Blvd. They are requesting Commercial-Business (C-B) zoning. The petition meets the requirements of the state annexation statute and 1007 Corporation are the owners of 100% of the land to be annexed exclusive of rights-of-way. 48% of the property is contiguous to existing city limits. Staff recommends Council adopt Resolution 033 and set a public hearing for December 15, 1987. Mayor Fauson moved that Council adopt Resolution 033 and a public hearing be set for December 15, 1987. Mohr seconded. Unanimous. PUBLIC SERVICE FRANCHISE AGREEMENT Hundley explained that last week, the City received notification by the Public Service Co. of Colorado of an increase in the franchise fee to be paid to the City of Louisville by virtue of an automatic increase contained in the City's frAnchise agreement with Public Service. Effective November 1, 1987, the franchise fee will be increased from 2% to 3% for any customer in Louisville, at any one location, whose annual gross revenue from the sale of gas and electricity is in excess of $5,000. The City will receive approximately $43,000 in additional revenues during 1988 as a result of the higher franchise fee. This is an automatic increase and requires no action on the part of Council. Szymanski asked what the term is of the current franchise agreement. Hundley explained that it is a 20 year agreement signed in 1977. The impact would be on large scale users and STC is the largest user in Louisville. OTHER: COAL CHEER PROJECT Hundley stated that staff received today the majority of the submittal package required for the annexation of the Coal Creek Project. Hundley asked that a Work Session be held on Wednesday, Nov. 11th at 7:30 p.m. The remaining documents will have been submitted by this time and the Nov. 11th meeting will be a joint session with the Planning Commis- sion and the Golf Association so that everyone can see the proposed project in full detail. APPROVAL OF EASEMENT AGREEMENTS WITH PUBLIC SERVICE COMPANY AND HOMART DEVELOPMENT CORP. Phare brought to Council the final two easements needed for the City's 24" Treated Water Pipeline frog the 2.0 MG High Zone Storage Tank to the existing distribution system. The Public Service easement is
