We did <br />raise a point, the distance of it, and the <br />response was it's within about a mile and it's <br />about as close as some of the other open space <br />that's included in part of the Parkway. That is <br />one issue that we need to get back on. <br /> <br />Sackett: To Councilwoman Hornbostel, my congratulations. I <br />appreciate your diplomacy and you really worked <br />hard on this and it's a great accomplishment. <br />Second, when I talked to Lafayette about including <br />that property, the problem I see is that Lafayette <br />after they annexed to our north is coming back to <br />us and saying, now we want you to give up open <br />space that is really in areas where we could <br />expand. And so they really gave away, when they <br />already took our border to the north. I just <br />think that we should not include that piece of <br />property in the Parkway Agreement. The IGA's are <br />not in my mind settled from my history on the <br />Council, even the Lastoka property. Not everybody <br />put up the money and there is still debate about <br />that. We should just not put it in this agreement. <br /> <br />Howard: Is it possible for the City of Louisville to annex <br />across open space? <br /> <br />Griffiths: Under the current annexation laws, County owned <br />open space is essentially a barrier to annexation. <br /> <br />Howard: If it's County owned, but if it is owned by cities <br />like Boulder is that a barrier? <br /> <br />Griffiths: You have to jump across it. It has to fall within <br />the exceptions under the annexation laws and my <br />recollection is the only open space specifically <br />address across which one cannot annex is County <br />owned open space. Now if there is other land <br />owned, you still have to address contiguity I <br />requirements. I would have to look at the <br />specific kind of annexation to see how the <br />contiguity requirements would apply, but I know <br />that County owned open space is a barrier. <br /> <br />Fauson: In response to that in the City of Northglenn has <br />done an annexation six miles from their city and <br />no contiguity whatsoever with their sewer plant, <br />they just had their sewer plant and annexed the <br />property. Assuming that, that was property next <br />to that was contiguity certified they annexed that <br />property and of course this is going to be debated <br />heavily with the State Legislatures and the City <br />of Thornton and there is a lot of question on <br />that.
