The decision as to whether any change <br />is non-substantive, or is substantive but does not <br />affect the City of Louisville, shall be made <br />jointly by Councilmember Hornbostel, the City <br />Administrator and the City Attorney. If anyone <br />of the three believes that a change is a <br />substantive change affecting the City of <br />Louisville, the Mayor is not authorized to execute <br />the Agreement with such change included. <br /> <br />I also would include a phrase that says on page 8 <br />paragraph 6.(a), second sentence, strike the word <br />"and" which appears immediately before the word <br />"provided". This is a grammatical change only. <br /> <br />A copy of the agreement approved by the motion <br />shall be attached to and become a part of the <br />minutes of this Council meeting. <br /> <br />A final copy of the Agreement executed by the <br />Mayor shall be provided to each member of the City <br />Council and shall also be attached to the minutes <br />of this Council meeting. <br /> <br />Exhibit B has an attachment one and an attachment <br />two. Councilwoman Hornbostel has worked very hard <br />on attachment one to insure that the access is <br />adequate to the roadway. It was our understanding <br />that these issues were generally taken care of at <br />the last meeting. I was asked if attachment one <br />and attachment two are binding? I think they are <br />and on reflection I don't know why we should worry <br />about that. In attachment two anything that says <br />Louisville/Dillon Road should be moved to <br />attachment one, which is binding. It was our <br />understanding that this was going to happen. I <br />would add a condition that states all the items <br />listed under the title Louisville/Dillon Road of <br />attachment two of Exhibit "B" be moved to <br />attachment one of Exhibit "B". <br /> <br /> <br />Hornbostel: We were trying to be very careful that all of our <br />requests were going to be binding. What we need <br />to do is have the two issues about the amendments <br />discussed and see how the Council feels. Our <br />access has been covered. I think all the other <br />concerns that have been raised have been <br />medicated. What I need to know is if there are <br />any other concerns that you have, that have not <br />been medicated and some discussion on the other <br />two issues. <br /> <br />Sackett: My opinion is that we should sign the agreement <br /> <br /> <br />6 <br />
