It would also be <br /> protective of the City. <br />Mayor Fauson closed the public hearing. <br />Sackett moved to adopt Ordinance No. 1050, Series 1991 - <br />Transferring by Quit Claim Deed any Title and Interest of the City <br />of Louisville in Certain Easements and Right-of-Ways as amended and <br />the Quit Claim Deed not be delivered until such time as the funds <br />are released to the City; seconded by Szymanski. Roll call was <br />taken on the motion. Motion passed 6-0. <br />Councilman Sackett requested that Item I under regular business; <br />Agreements with Cherryvale Fire Protection District and Louisville <br />Fire Protection Districts to exclude certain properties from <br />Cherryvale Fire Protection District be moved prior to going into <br />the Executive Session. All in favor. <br />AGREEMENTS WITH CHERRYVALE FIRE PROTECTION DISTRICT AND LOUISVILLE <br />FIRE PROTECTION DISTRICTS TO EXCLUDE CERTAIN PROPERTIES FROM <br />CHERRYVALE FIRE PROTECTION DISTRICT <br />Annette Brand, City Administrator, reviewed the proposed agreement <br />between the City of Louisville and Cherryvale Fire Protection <br />District. Revisions have been made by the City of Louisville City <br />Attorney. Kevin Klein, Fire Chief of Cherryvale Fire Protection <br />District, has not had an opportunity to take this revision back to <br />the Cherryvale Fire Protection District Board. Brand explained to <br />Council that the 5th "Whereas," in the agreement states that <br />Louisville has entered into an intergovernmental agreement with <br />Louisville Fire Protection District. That is in process now. Brand <br />will be meeting with the Louisville Fire Protection District to <br />review the agreement. The agreement talks about there being no <br />policy in the City of Louisville for Louisville land to be served <br />by Louisville Fire Protection District. The City of Louisville has <br />annexed some property that is in the Cherryvale District and <br />Cherryvale doe not intend to be obligated for that property beyond <br />January 1, 1992. The agreement also mentions that there are <br />covenants and agreements; the first one is the covenant that the <br />Cherryvale Fire Protection District would reconsider its decision <br />of October 9, 1990 where it declined to exclude this property from <br />its district. In the agreement Cherryvale has agreed to exclude <br />the property in question and also agrees to exclude three <br />additional parcels at the time they are annexed, if Cherryvale is <br />petitioned to do so by the owners of the property. There are two <br />other parcels that are on the other side of Highway 36 which would <br /> 7 <br />
