It is zoned for commercial or residential. <br />Davidson: The adjustment in the resolution refers to if Storck buys <br /> the land, what if someone else buys the land? <br />Franklin: If someone else buys the land and attempted to do a <br /> small single family project they would not get far <br /> because the access difficulties would be extreme. If it <br /> isn't a single family project then the concern goes away. <br /> I think the concern was that nobody but Storck will <br /> have an opportunity to buy the ground that is next to <br /> this project for single family detached residential. <br /> Therefore, Storck will have control over its' own destiny <br /> rather than try to introduce a third party and then stop <br /> Storck while the third party decides whether it is going <br /> to bother to redesign the streets to fit in with this <br /> development. <br />Davidson: If Storck decides not to buy that land for whatever <br /> reason, and this development went through all three <br /> phases and then the land was sold and it was zoned for <br /> residential, the new owner would have a right by use as <br /> it is zoned. Is this not pretty poor planning to have a <br /> piece of land zoned for potential single family homes <br /> and us to allow building around it such that there is no <br /> access or poor access? <br />Franklin: In the strictest sense of control of land use, possibly. I <br /> think there is a concern about Storck proceeding to <br /> develop with no potential for acquisition of the property <br /> next door and being held up in Phase III while we all <br /> wait around for someone to buy the ground in ten or <br /> fifteen years. I think that concern about third party <br /> control bothers Storck to the extent that the land would <br /> be platted and the project stalled for an infinite amount <br /> of time. <br />Shonkwiler: There is a fault line that runs north of this property <br /> across that piece which was to have been the Village. <br /> 21 <br />
