RESOLUTION NO. 22 <br />SERIES 2010 <br />A RESOLUTION APPROVING A LEASE AGREEMENT FOR THE LEASE OF 637 <br />FRONT STREET, CITY OF LOUISVILLE <br />WHEREAS, the City is the owner of the former Post Office Building at 637 Front Street, <br />located on Lots 1, 2, 3, 4 & 5, Block 4, Town of Louisville, County of Boulder, State of <br />Colorado, which lot has an address of 637 Front Street and upon which lot is located a one-story <br />masonry building; and <br />WHEREAS, LuckyPie llc desires to lease such property from the City and the City is <br />willing to lease such property to LuckyPie llc; and <br />WHEREAS, a lease agreement has been proposed for such lease, and the City is <br />authorized to enter into such a lease pursuant to its home rule charter and other applicable law; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. The proposed Lease Agreement between the City of Louisville and LuckyPie <br />llc of Lots 1, 2, 3, 4 & 5, Block 4, Town of Louisville is hereby approved in essentially the same <br />form as the copy of such Lease Agreement accompanying this Resolution. <br />Section 2. The Mayor is hereby authorized to execute the Lease Agreement, except that <br />the Mayor and City Manager, or either of them, is hereby further granted the authority to negotiate <br />and approve such revisions to said Lease Agreement as are determined necessary or desirable for the <br />protection of the City, so long as the essential terms and conditions of the Lease Agreement are not <br />altered. <br />Section 3. The City Manager and City Staff are further authorized to do all things <br />necessary on behalf of the City to perform the obligations of the City under the Lease Agreement <br />and to execute and deliver any and all documents necessary to effect the lease under the terms and <br />conditions of the Lease Agreement. <br />ADOPTED this 2Aday of <br />• <br />g <br />L • <br />• <br />T EST: <br />e• ..... <br />ancy Varra, City Clerk <br />Cha <br />, 2010. <br />Sisk, Mayor <br />
