.. Section 9. Cons truc t ion Contrac ts. The appropriate officers of the City are hereby authorized to obtain bids to const'::-:J.Ct .:-'- - ?roje....:t. i:1 accon-:ance with the requi:cements of t~;.9 l~ L ~tj Pe tit ion. Section 10. Special 3enefits. The Counc il hereby finds and determines that the proj ect wi II confer a special benefit upon the property within the District. Section 11. Findings and Declarations as to peti t ion. The Coun c il hereby finds and determines that the Pe tit ion was presented in accordance with law, that it was signed by one h und red percent (100%) of the owners of property to be asse ssed , that it contained a request for a waiver of the requirements for notice, publication, and a hear ing as provided in Section 31-25- 503, C. R. S. , and that in accordance with the pe tit ion, such notice, publication, and hearing shall be wa ived. Section 12. Authoriza tion to Execute Agreement. The Council hereby finds and de te rmines that execution of the agreement appended to the Petition is in the best interests of the City, and the t1ayor and City Clerk are hereby authorized to execute such agreement on behalf of the City. Section 13. Repealer. All acts, orders, ordinances, or resolutions, or parts thereof, in conflict herewith, are hereby repealed to the extent of such conflict. Section 14. Severability. Should any one or more sections or provisions of this Ordinance be judicially determined invalid or unenforceable, such de termina tion shall not affect, impa i r , or i nval ida te the rerna in i ng provisions hereof, the intention being that the various provisions hereof are severable. Section IS. Record i ng and Authentication. This Ordinance, immediately on its passage, shall be recorded in the City Book of Ordinances kept for that purpose, shall be authenticated by the signatures of the r1ayor and City Clerk, and shall be published in accordance with law. Section 16. Declaration of Emergency. By reason of the fact that the improvements described in this Ordinance are needed immediately and must be started dur ing the present construction - 7 -
