Louisville City Council <br />Summary of Open Meetings /Open Records Requirements <br />& Guidelines for Councilmembers <br />Draft 2/6/2004 <br />The following is a summary for City Councilmembers of the basic open meetings requirements of <br />state law and the City Charter. ' Also included are guidelines on handling open meetings, public <br />records and e -mail issues. Questions on specific matters or areas of uncertainty may be addressed to <br />City Staff or the City Attorney's office.. <br />OPEN MEETINGS <br />1. All meetings of three or more Councilmembers at which any public business is <br />discussed or at which any formal action may be taken are open public meetings. <br />2. Any meeting at which the adoption of any proposed policy, position, ordinance, <br />resolution, rule, regulation or formal action occurs are open public meetings and <br />require full and timely public notice. <br />3. Any meeting at which four or more Councilmembers are in attendance, or are <br />expended to be in attendance, are open public meetings and require full and timely <br />public notice. <br />4. There are stricter meeting limits for three- person City Council committees. For these <br />committees, a meeting of two or more members is an open public meeting and <br />requires full and timely public notice. <br />5. The above requirements extend to non - social meetings called by another entity if four <br />or more Councilmembers will attend or are expected to attend. If you plan to attend <br />such a meeting, inform the City Manager's office so that it may track potential <br />attendance by Councilmembers and post a meeting notice if required. <br />6. The above requirements do not apply to any chance meeting or social gathering at <br />which discussion of public business is not the central purpose. <br />7. Executive sessions are limited to regular or special City Council meetings, and only <br />for the purposes of discussing (a) information required to be kept confidential by law; <br />(b) limited personnel matters: (c) certain aspects of water and property acquisitions; <br />or (d) pending or imminent litigation. <br />8.
