DPS \56925 \478939.02 <br />DRAFT CITY OF LOUISVILLE ORDINANCE <br />provided that the undergrounding shall extend for a minimum distance of one (1) block or <br />750 feet, whichever is less, or as may be mutually agreed by the parties. Upon mutual <br />agreement of the Company and City, funds from such allocation may be utilized for the <br />purposes of undergrounding overhead electric transmission facilities in the City. No <br />relocation expenses which the Company is required to expend pursuant to Article 4 shall <br />be charged to this allocation. Any unexpended portion of the one percent (1 %) of such <br />Electric Revenues shall be carried over to succeeding years and, in addition, upon request <br />by the City, the Company agrees to anticipate amounts to be available under the <br />preceding paragraph for up three (3) years in advance. Any amounts so advanced shall be <br />charged against otherwise available amounts which would have been expended in <br />succeeding years until such advance is eliminated. The final decision as to which projects <br />are selected for undergrounding rests with the City, subject to the provisions of this <br />Article. The specific scheduling of such projects rests with the Company, which shall <br />make every reasonable effort to complete such projects within the time requested by the <br />City. <br />§9.2 Relocation Expenses Not Charged Against Remaining Balances. No. relocation expenses <br />which the Company is required to expend pursuant to Article 4 shall be charged against <br />the balance remaining in the existing underground fund, nor shall the City be responsible <br />for such costs. <br />§9.3 System -Wide Undergrounding Costs. If the Public Utilities Commission requires a <br />system -wide program or programs of undergrounding electric distribution facilities at <br />Company expense, the City shall not be responsible for paying the costs of any <br />undergrounding pursuant to such program. <br />§9.4 Review of Undergrounding Projects. The City and the Company shall mutually plan in <br />advance the scheduling of approved undergrounding projects to be undertaken according <br />to this article as part of the review and planning for other Company construction projects. <br />-12- <br />
