Under current law, cities may also chose the "open market" approach <br />whereby citizens make their own arrangements for trash, similar to the proposed <br />legislation. Therefore, the City supports the following positions: <br />Position. <br />• Retain ability to decide locally whether to use the "market approach" or chose a <br />city billing option. <br />• Oppose efforts to mandate "market approach" and thus ensure the most efficient <br />collection and processing of recyclable material and solid waste. <br />9) Governmental Liability <br />In July of 2003, the Colorado Court of Appeals decided tlat a milrucipality is liable for <br />costs incurred by medical providers in providing medical care to a person in the custody <br />of the municipality's police department.
