RESOLUTION NO. 39 <br /> SERIES 2010 <br /> A RESOLUTION APPROVING A SPECIAL REVIEW USE (SRU) TO ALLOW FOR OUTDOOR <br /> SEATING FOR THE LUCKYPIE PIZZA RESTAURANT LOCATED AT 637 FRONT STREET <br /> WHEREAS, there has been submitted to the Louisville City Council an application for <br /> approval of a request for a special review use (SRU) to allow for outdoor seating for the <br /> LuckyPie Restaurant located at 637 Front Street; and <br /> WHEREAS, the City Staff has reviewed the information submitted and found it, with <br /> conditions, to comply with Louisville zoning regulations, required general and specific design <br /> standards, and the City's special review use criteria and other applicable sections of the <br /> Louisville Municipal Code; and <br /> WHEREAS, after a duly noticed public hearing on June 10, 2010, where evidence and <br /> testimony were entered into the record, including the findings in the Louisville Planning <br /> Commission Staff Report dated June 10, 2010, the Planning Commission recommended <br /> approval of said special review use with conditions: <br /> 1. Pine Street access shall remain as an "in- only" one way access. <br /> 2. Hours of operation for the outdoor patio shall be limited to 12 am. <br /> 3. Patio lighting should be limited to low wattage down -cast lighting only. <br /> 4. Potted planting structures shall be placed throughout the outdoor patio area. <br /> 5. The applicant must show how trash and recycling dumpsters will be accommodated on <br /> the property. <br /> 6. The applicant shall provide six (6) bike parking spaces on site; and <br /> WHEREAS, City Council has reviewed the application, including the recommendation of <br /> the Planning Commission, and finds that it complies with Chapter 17.40.100 of the Louisville <br /> Municipal Code; <br /> NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, <br /> Colorado does hereby approve a special review use (SRU) to allow for outdoor seating for the <br /> LuckyPie Restaurant located at 637 Front Street, with the following conditions: <br /> 1.
