RESOLUTION NO. 41 <br /> SERIES 2010 <br /> A RESOLUTION CALLING A SPECIAL ELECTION FOR NOVEMBER 2, 2010, TO BE <br /> CONDUCTED AS A COORDINATED ELECTION, FOR THE PURPOSE OF <br /> SUBMITTING A TABOR BALLOT ISSUE TO THE REGISTERED ELECTORS OF <br /> THE CITY <br /> WHEREAS, the City Council finds it in the best interests of the City of Louisville to call <br /> a special election for November 2, 2010 to be conducted as a coordinated election, for the <br /> purpose of referring to the registered electors of the City a TABOR ballot issue concerning a <br /> proposed use tax; and <br /> WHEREAS, pursuant to Section 6 -3 of the Home Rule Charter, the City Council may <br /> call a special election by resolution adopted not less than 60 days prior to the date of the election. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF LOUISVILLE, COLORADO: <br /> Section 1. A special election is hereby called to be held on Tuesday, November 2, <br /> 2010 as part of a coordinated election. <br /> Section 2. The purpose of the special election will be to submit to the registered <br /> electors of the City a TABOR ballot issue concerning a proposed use tax. The City Council may <br /> submit such TABOR ballot issue to appear on the ballot of the special municipal election by the <br /> adoption of appropriate resolution or ordinance as required by law. <br /> Section 3. The officers and employees of the City are hereby authorized and directed <br /> to take all necessary and appropriate actions to effectuate the provision of this Resolution in <br /> accordance with Colorado law. <br /> Section 4. Pursuant to C.R.S. Section 31 -10- 102.7, the City will utilize the <br /> requirements and procedures of the Uniform Election Code of 1992, articles 1 to 13 of title 1, <br /> C.R.S., as amended, in lieu of the Colorado Municipal Election Code of 1965, article 10 of title <br /> 31, C.R.S., as amended, with respect to the special municipal election to be held on November 2, <br /> 2010, and such election shall be conducted as part of the coordinated regular election. <br /> PASSED AND ADOPTED this 22n day of July, 2010. <br /> 1 <br /> 4 <br /> C *a Sisk, Mayor <br /> Resolution No. 41, Series 2010 <br />
