R. If the civil fine is not paid when due or upon entry of a civ- <br />il judgement by the hearing officer, the City may commence proce- <br />dures to collect the fine, including commencement of a civil action <br />to collect the fine. A person found to be in violation of this Chapter <br />shall be responsible for all costs of collection, including reasonable <br />attorney fees. <br />S. All decisions by the hearing officer shall be final subject <br />only, to judicial review pursuant to Rule 106 of the Colorado Rules of <br />Civil Procedure. <br />Sec. 2.17.040 070. Enforcement by City Clerk. <br />If the City Clerk believes that a violation of the Article XXVIII, <br />or the FCPA or this Chapter has occurred, the City Clerk may com- <br />mence enforcement proceedings in accordance with the proce- <br />dures set forth in Section 2.17.030 2.17.060 of this Code. <br />Sec. 2.17.050 080. Rules and regulations. <br />The City Clerk is authorized to adopt such rules and regulations <br />consistent with the provisions hereof as may be required to imple- <br />ment this Chapter. <br />Section 2. If any portion of this ordinance is held to be invalid <br />for any reason, such decision shall not affect the validity of the re- <br />maining portions of this ordinance. The City Council hereby de- <br />clares that it would have passed this ordinance and each part here- <br />of irrespective of the fact that any one part be declared invalid. <br />Section 3. The repeal or modification of any provision of the <br />Municipal Code of the City of Louisville by this ordinance shall not <br />release, extinguish, alter, modify, or change in whole or in part any <br />penalty, forfeiture, or liability, either civil or criminal, which shall <br />have been incurred under such provision, and each provision shall <br />be treated and held as still remaining in force for the purpose of <br />sustaining any and all proper actions, suits, proceedings, and pros- <br />ecutions for the enforcement of the penalty, forfeiture, or liability, <br />as well as for the purpose of sustaining any judgment, decree, or <br />order which can or may be rendered, entered, or made in such ac- <br />tions, suits, proceedings, or prosecutions. <br />Section 4. All other ordinances or portions thereof inconsis- <br />tent or conflicting with this ordinance or any portion hereof are <br />hereby repealed to the extent of such inconsistency or conflict. <br />INTRODUCED, READ, PASSED ON FIRST READING, AND OR- <br />DERED PUBLISHED this 16th day of April, 2024. <br />Christopher M.
