There is established a water use rebate program to provide financial assistance payments to <br />qualifying individuals, as set forth in this section. In order to receive a water use rebate payment, <br />the applicant must meet all qualifications as set forth in subsection B of this section and must <br />make application therefor annually at such time and in such manner as is required by the director <br />of finance. The director of finance may establish rules and forms consistent with this section for <br />administration of the water use rebate program. <br />B. To qualify for a water use rebate payment, an applicant must meet all of the following <br />requirements: <br />1. The applicant or spouse must be 65 years of age or older by August 1 of the year in which the <br />application is submitted. <br />2. The applicant must have been a resident of the city for a majority of the calendar year <br />preceding the calendar year in which the application is made. No water use rebate shall be <br />paid to any resident of any dwelling for any specific period of time if any other resident of that <br />same dwelling has received or is entitled to receive a water use rebate for the same period of <br />time. <br />3. The applicant or spouse must have paid property taxes or rent on or for a dwelling unit on <br />which property taxes were assessed for all or a majority of the calendar year preceding the <br />year in which the application is submitted. <br />4. The applicant's total annual household income does not exceed $25,000.00. <br />5. Application for payment shall be verified by the applicant and must be made within such time <br />as is established by the director of finance. <br />C. The maximum amount of the annual water use rebate paid to a qualifying applicant shall be <br />$100.00. Such amount shall be paid either by city check or through a credit given on the water <br />account of the applicant, as determined annually by the director of finance. <br />D. As used in this section 13.12.105, the terms "dwelling" and "dwelling unit" mean any structure, <br />residence, abode, room, habitation, apartment, or lot or plot of land in or upon which the <br />applicant or applicant's spouse permanently resides; excluding, however, any part or portion of <br />such dwelling which is rented or let out to others or is used for a business purpose. <br />E. Payment of water use rebates is subject to annual budgeting and appropriation of funds therefor, <br />and funding for such program may be provided or withheld year-to-year as city council in its <br />discretion shall determine. <br />(Ord.
