RESOLUTION NO. 7 <br /> SERIES 2011 <br /> A RESOLUTION MAKING FINDINGS REGARDING THE LANDMARK DESIGNATION <br /> APPLICATION FOR THE STREET FACING FALSE FRONT OF THE REX THEATER, <br /> LOCATED AT 817 MAIN STREET <br /> WHEREAS, there has been submitted to the Louisville Historic Preservation <br /> Commission (HPC) an application requesting a landmark eligibility determination for the <br /> street facing false front on the Rex Theater, located at 817 Main Street, on property <br /> legally described as south 5 feet of Lot 10 the north 20 feet of Lot 11, Block 5, Town <br /> of Louisville, City of Louisville, State of Colorado; and <br /> WHEREAS, the City Staff and the HPC have reviewed the application and found <br /> it to be in compliance with Chapter 15.36 of the Louisville Municipal Code, including <br /> Section 15.36.050.A, establishing criteria for landmark designation; and <br /> WHEREAS, after a duly noticed public hearing on January 10, 2011, where <br /> evidence and testimony were entered into the record, including the findings in the <br /> Louisville HPC Staff Report dated January 10, 2011, the HPC found the structure <br /> ineligible for Landmarking and recommended approval of a conservation easement <br /> without condition; and <br /> WHEREAS, the street facing false front was constructed between 1900 1908, <br /> and has been significantly altered since that time; and <br /> WHEREAS, the street facing false front is a part of a structure that has social <br /> significance because of its association with a place of social gathering which has been a <br /> significant contribution to the socio- economic development of the City throughout the <br /> twentieth century; and <br /> WHEREAS, the City Council finds that these and other characteristics specific to <br /> the street facing false front have social significance as described in Section 15.36.050.A <br /> of the Louisville Municipal Code; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE, COLORADO: <br /> 1. That a conservation easement for preservation of the street facing false <br /> front for 817 Main Street, Louisville be obtained as part of any project for <br /> development of the property, to preserve features thereof that contribute to and <br /> Resolution No. 7, Series 2011 <br /> Page 1 of 2 <br />
