RESOLUTION NO. 7 SERIES 2011 A RESOLUTION MAKING FINDINGS REGARDING THE LANDMARK DESIGNATION APPLICATION FOR THE STREET FACING FALSE FRONT OF THE REX THEATER, LOCATED AT 817 MAIN STREET WHEREAS, there has been submitted to the Louisville Historic Preservation Commission (HPC) an application requesting a landmark eligibility determination for the street facing false front on the Rex Theater, located at 817 Main Street, on property legally described as south 5 feet of Lot 10 the north 20 feet of Lot 11, Block 5, Town of Louisville, City of Louisville, State of Colorado; and WHEREAS, the City Staff and the HPC have reviewed the application and found it to be in compliance with Chapter 15.36 of the Louisville Municipal Code, including Section 15.36.050.A, establishing criteria for landmark designation; and WHEREAS, after a duly noticed public hearing on January 10, 2011, where evidence and testimony were entered into the record, including the findings in the Louisville HPC Staff Report dated January 10, 2011, the HPC found the structure ineligible for Landmarking and recommended approval of a conservation easement without condition; and WHEREAS, the street facing false front was constructed between 1900 1908, and has been significantly altered since that time; and WHEREAS, the street facing false front is a part of a structure that has social significance because of its association with a place of social gathering which has been a significant contribution to the socio- economic development of the City throughout the twentieth century; and WHEREAS, the City Council finds that these and other characteristics specific to the street facing false front have social significance as described in Section 15.36.050.A of the Louisville Municipal Code; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. That a conservation easement for preservation of the street facing false front for 817 Main Street, Louisville be obtained as part of any project for development of the property, to preserve features thereof that contribute to and Resolution No. 7, Series 2011 Page 1 of 2
