Hill, P.C. <br />February 17, 2011 <br />Re: Update on Pending Water Matters <br />Please let this letter serve as an update on pending water <br />matters for the City for the Water Committee meeting on March 4, <br />2011. <br />Pending Water Court Applications <br />The City presently has two pending water court <br />applications. A water court application was filed in December, <br />2007, seeking to incorporate water associated with additional <br />Farmer's Reservoir and Irrigation Company (FRICO) Marshall <br />shares and South Boulder and Coal Creek (SBCC) shares into <br />Louisville's system. The application includes shares acquired <br />by the City since the last transfer of Marshall and SBCC was <br />completed in 1995. <br />This case will allow water associated with the more <br />recently acquired FRICO/Marshall and SBCC shares to be <br />incorporated into the City's system, adding to the City's water <br />rights portfolio. <br />A separate letter which details the City's options for <br />proceeding with this case, is included with this letter. <br />The other pending application seeks to make absolute <br />certain previously conditionally decreed water rights, and to <br />maintain the conditional status of other water rights, all <br />involving the irrigation of Coal Creek Golf Course. Two <br />statements of opposition were filed, by the City of Lafayette, <br />and the City of Westminster. We are waiting to receive comments <br />back from both parties.
