Tienken
Hill
Mr. Malcolm Fleming
City Manager
CITY OF LOUISVILLE
749 Main Street
Louisville CO 80027
Dear Malcolm,
ATTORNEYS James C. Tienken, P.C.
AT LAW Alan G. Hill, P.C.
February 17, 2011
Re: Update on Pending Water Matters
Please let this letter serve as an update on pending water
matters for the City for the Water Committee meeting on March 4,
2011.
Pending Water Court Applications
The City presently has two pending water court
applications. A water court application was filed in December,
2007, seeking to incorporate water associated with additional
Farmer's Reservoir and Irrigation Company (FRICO) Marshall
shares and South Boulder and Coal Creek (SBCC) shares into
Louisville's system. The application includes shares acquired
by the City since the last transfer of Marshall and SBCC was
completed in 1995.
This case will allow water associated with the more
recently acquired FRICO/Marshall and SBCC shares to be
incorporated into the City's system, adding to the City's water
rights portfolio.
A separate letter which details the City's options for
proceeding with this case, is included with this letter.
The other pending application seeks to make absolute
certain previously conditionally decreed water rights, and to
maintain the conditional status of other water rights, all
involving the irrigation of Coal Creek Golf Course. Two
statements of opposition were filed, by the City of Lafayette,
and the City of Westminster. We are waiting to receive comments
back from both parties. We anticipate that both opposers will
stipulate to the entry of a decree.
awr In the Hito,ic State Mercantile Building 801 Main Str,:et, Suite 120 4- PO [lox 550 4- oukville, CO 80027 Phone 303.673.9373 Fax 303.926.0853
