The applicant is proposing to build a deck that further encroaches into the setback, instead <br />of requesting a variance that meets the existing garage setback of 3.1 feet. In order to meet <br />this criterion, staff finds that the proposal would need to be redesigned to meet the existing <br />3.1-foot setback of the garage. However, the BOA previously found that the application met <br />this criterion given that the foundation of the garage would remain in the same location as <br />existing. Staff finds the proposal has met this criterion. <br />PUBLIC COMMENTS: <br />Over a dozen public comments that were received during the initial variance request are <br />attached. <br />No additional comments have been received as of this report. <br />STAFF RECOMMENDATION: <br />Staff recommends approval of the variance. <br />BOARD ACTION: <br />The Board may approve (with or without condition or modification), deny, or continue the <br />application to a future meeting for additional consideration. The Board may also request <br />additional information if they feel it is needed for their proper consideration of the variance <br />application. In approving an application, the Board must find that all six variance criteria, <br />insofar as applicable, have been met.
