leaning toward denying the variance, or are preconceived to deny this, let me know and we
will.. .. .

Sears: Okay. I think it would be good at this time if all members of the Board might
express what contact we've had up to now and, it really isn't our call. Hopefully, we don't
have any preconceived outcome here. But, if that would be a good way to proceed here,
I think you might get an idea of what we've gone through this far but we are looking
forward to seeing your presentation as well as hearing from opponents, and making a
decision based on all the information and being objective as possible. So...

Eisenstein: If I could just say, Mr. Chairman, we are anxious to go ahead and do our
presentation now, as soon as possible, and proceed with the public hearing. However, we
were as anxious to have five members present so, we are sort of on the lines of dilemma.
So, that is why I was going for some sort of straw vote or something.

Sears: Okay. Well, if I can direct this question at the members of the Board, then....has
anybody had contact with either the applicant or the opponent, or any City representatives
regarding this issue? And, if so, if you would state when and what and, I guess, also make
a determination as to whether you feel your vote might be influenced by what you've heard
thus far.

Pendergrast: Should I go first? I, Steve Pendergrast, have had contact today. I went to
the property and looked. The neighbor to the north, I think a Mr. Campbell, was outside
and he approached me. I told him I didn't want to talk about it. He did say, "Well, I'm
glad that you are here so you can see that it is the site." I also taked with Ray Sears, who,
by happenstance, showed up at the property at the same time. We also went to look at
another property that we had granted a variance to, that is very similar to this one, at 2402
McKinley. That variance was granted back in March. Proceeding from there, Ray and I
talked to Paul Wood. I can't remember the full gist of the conversation. While I was
looking at the property and checking off signatures versus what was listed on your
signatures as to properties close around that were affected, another neighbor approached
me who is not here at this hearing. He said he had no objection to it at all. Two people
have stated their opinion to me, outside of the Hall and Rick. I have to say that in any
hearing I go in with Board approval upon the applicant. And, that is the way I have always
been. I have to say that I have only voted no once in three or four years of being on the
Board. You can take that however you want. And, for the applicant at 2404, I did vote
yes. I can't guarantee how I'd vote tonight.

Eisenstein: Thank you for that information.

Sears: I will go next and we will just continue down the line. I got a phone call from
Lowell Campbell on Tuesday, June 4th. He was concerned about our objectivity and that
we should try to get out and get as much information on the property as possible. He just
wanted to make sure that we would and that all the members of the Board would get out

3
