ORDINANCE NO. 1658 <br /> SERIES 2014 <br /> AN ORDINANCE AUTHORIZING THE EXCHANGE OF INTERESTS IN PARCELS OF <br /> PROPERTY OWNED BY THE CITY OF LOUISVILLE AND THE COLORADO <br /> DEPARTMENT OF TRANSPORTATION FOR COMPLETION OF SEGMENT E OF <br /> PHASE II OF THE US 36 MANAGED LANE/BUS RAPID TRANSIT PROJECT <br /> WHEREAS, the City of Louisville is the owner of a parcel of property referred to as Parcel <br /> Number 8D (containing 12,782 square feet ±), which parcel is part of the McCaslin Boulevard <br /> right-of-way at the intersection of US 36 and McCaslin Boulevard, and which parcel is legally <br /> described on Exhibit A attached hereto (hereinafter"Parcel 8D"); and <br /> WHEREAS, the City of Louisville previously owned and by Ordinance No. 1129, Series <br /> 1994 vacated its interests in a parcel of property referred to as Parcel Number 8E (containing 3,407 <br /> square feet ±), which parcel was part of the 80th Street right-of-way adjacent to the intersection of <br /> US 36 and McCaslin Boulevard, and which parcel is legally described on Exhibit A attached hereto <br /> (hereinafter"Parcel 8E"); and <br /> WHEREAS,by its erroneous inclusion within a plat dedication, the City of Louisville has a <br /> purported interest in a parcel of property referred to as Parcel Number 8F (containing 759 square <br /> feet ±), which parcel was conveyed to the Colorado Department of Transportation (hereinafter <br /> "CDOT") in 1982 but was erroneously including within an area dedicated as Tract A, Colony <br /> Square (a/k/a Parcel S-3), and which parcel is adjacent to the US 36 right-of-way at the intersection <br /> of US 36 and McCaslin Boulevard and legally described on Exhibit A attached hereto (hereinafter <br /> "Parcel 8F;"Parcels 8D, 8E and 8F are hereinafter collectively referred to as "the Parcels"); and <br /> WHEREAS, the Colorado Department of Transportation (hereinafter "CDOT") is the <br /> owner of a parcel of property referred to as Parcel Number 25REV X (containing 4,991 square feet <br /> ±), which parcel is part of CDOT Parcel 25Rev as delineated on its Project No. T170-1(0) at the <br /> intersection of US 36 and McCaslin Boulevard, and which parcel is legally described on Exhibit A <br /> attached hereto (hereinafter"Parcel 25 REV X"); and <br /> WHEREAS, CDOT has advised the City that the Parcels are required for CDOT's <br /> completion of Phase II the US 36 Managed Lane/Bus Rapid Transit Project, CDOT Project Code <br /> 18907, Project No. NH 0361-103, Segment E(hereinafter"the Project"); and <br /> WHEREAS, CDOT and the City have further determined that the areas within the Parcels <br /> have been maintained by CDOT and the area within Parcel 25REV X has been maintained by the <br /> City, and CDOT and the City desire to exchange Parcel 25REV X for the City's interests in the <br /> Parcels in order to align and clear title to CDOT's and the City's respective ownership interests and <br /> maintenance areas at the intersection of US 36 and McCaslin Boulevard; and <br /> WHEREAS, CDOT has further advised the City that CDOT would, if necessary, exercise <br /> Ordinance No. 1658, Series 2014 <br /> Page 1 of 3 <br />
